Legal position · DACH
Three legal systems, one answer: the mandate holds
Agency has been codified in the DACH region for more than a century — and it is technology-neutral. What agents needed was never new law, but an evidence format that satisfies the existing one. The profiles in detail:
Switzerland
Agent mandates under Swiss law
Switzerland offers the agent mandate the clearest foundation in the DACH region: agency under Art. 32 ff. of the Code of Obligations is technology-neutral, revocation is possible at any time (Art. 34 CO), and with the state trust infrastructure (expected to go live in H1 2027; the E-ID itself has had no fixed date since 30 June 2026) the identity root gains state rank — on the same technical stack the Open Mandate Protocol uses.
Germany
Agent mandates under German law
Germany demands doctrinal precision for the agent mandate: §§ 164 ff. BGB govern agency, the «computer declaration» is recognised, and attribution is decided by the documented margin of discretion of the system — exactly what structured constraints provide. With the EUDI obligation (deadline 24 December 2026) and the German state wallet from 2 January 2027, the identity root becomes available on a regulated basis.
Austria
Agent mandates under Austrian law
Austria governs authorisation in the ABGB (§§ 1002 ff.): the contract of authorisation combines instruction and authority, the scope is determined by the nature of the transaction (§ 1029 ABGB), and revocation is permitted at any time. For agents this means: a generic authority with clear limits is the natural frame — and ID Austria already provides a state identity basis today.
Note: these pages explain the legal position in general terms and do not replace legal advice in an individual case. Responsibility for the limits set lies with the person granting the mandate.
